3. Client Responsibilities

By entering into an agreement with The Local Carpenter, you agree to:

  • Provide accurate and complete information about the project, including project scope, location, and other specifications.
  • Prepare the site for work by ensuring access, safety, and adequate utilities are available as required.
  • Make timely payments as outlined in the quote or service agreement.
  • Cooperate with our team to facilitate smooth communication and project completion.

Failure to meet these responsibilities may result in delays or additional costs.


4. Payments

4.1 Payment Terms

The Client agrees to make payments in accordance with the payment schedule outlined in the service agreement or quote. Payment terms include:

  • A deposit is required prior to the start of work.
  • The balance is due upon project completion or as specified in the agreement.

We accept payments through bank transfer, credit/debit cards, and other approved payment methods.

4.2 Non-Payment

In the event of non-payment, The Local Carpenter reserves the right to suspend or terminate the project until payment is received. Failure to pay within the agreed terms may result in additional fees or legal action.


5. Cancellations and Modifications

5.1 Client Cancellations

You have the right to cancel or reschedule your project. However, cancellation must be made at least 7 days in advance to avoid a cancellation fee.

5.2 Modifications to Project

Changes or modifications to the project after work has commenced may result in additional costs and a revised project timeline. All modifications must be discussed and agreed upon in writing.

5.3 The Local Carpenter’s Right to Cancel

The Local Carpenter reserves the right to cancel or suspend the project if:

  • Payments are not received in a timely manner.
  • Safety concerns arise that cannot be addressed.
  • Material shortages or supply chain disruptions prevent us from completing the project.

In such cases, the Client will be notified, and any payments made will be adjusted based on the work completed up to that point.


6. Liability and Indemnification

6.1 Limitations of Liability

The Local Carpenter is not liable for:

  • Any indirect, incidental, or consequential damages resulting from the project.
  • Loss or damage due to third-party actions, including but not limited to subcontractors, suppliers, or clients’ failure to comply with safety instructions.

Our liability is limited to the total amount paid for the services rendered under the specific agreement.

6.2 Indemnification

You agree to indemnify and hold harmless The Local Carpenter from any and all claims, damages, or liabilities arising from:

  • Your breach of these Terms.
  • The misuse of our services.
  • Any injury or damage resulting from improper use or modifications of the completed work.

7. Warranties and Guarantees

We provide a workmanship warranty on all carpentry services, typically covering a 12-month period from the date of completion. This warranty covers defects in workmanship, but not damage due to misuse or external factors.


8. Confidentiality

The Local Carpenter respects the confidentiality of your project and any information shared. All project details, designs, and specifications are kept confidential and are not shared with third parties unless:

  • Required by law.
  • Explicit consent is given by the client.

9. Dispute Resolution

In the event of a dispute, both parties agree to attempt to resolve the issue through negotiation or mediation before pursuing any legal remedies.

If a resolution cannot be reached, both parties agree to arbitration in Adelaide, South Australia, under the rules of the Australian Centre for International Commercial Arbitration (ACICA).


10. Intellectual Property

Any designs, plans, or other creative materials produced by The Local Carpenter during the course of the project are the intellectual property of The Local Carpenter, unless otherwise agreed upon in writing. Clients are granted a license to use such materials for their specific project, but no ownership rights are transferred.


11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Australia, and any disputes shall be resolved in the courts located in South Australia.


12. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be posted on this page, and the “Last Updated” date will be updated accordingly. It is your responsibility to review these Terms periodically for any updates.
